Knox County lawyer censured


On January 29, 2020, Bailey McKillop Harned, an attorney licensed to practice law in Tennessee, received a Public Censure from the Board of Professional Responsibility of the Tennessee Supreme Court.

Ms. Harned was retained by the minor child’s mother to reinstate visitation that the child’s father had unilaterally stopped. Ms. Harned was paid a flat fee. Although she did not obtain a written fee agreement, she did not deposit the fee into her trust account. Ms. Harned failed to communicate with her client and finally filed a petition to modify custody on the client’s behalf more than one (1) year after she was retained. At that time, it was discovered that the minor child had been adopted by the father’s new wife sixteen (16) months earlier.

By these acts, Ms. Harned, has violated Rule of Professional Conduct 1.1 (competence), 1.3 (diligence), 1.4 (communication), and RPC 1.15 (safekeeping property and funds) and is hereby Publicly Censured for these violations.

A Public Censure is a rebuke and warning to the attorney, but it does not affect the attorney’s ability to practice law.
